13.3 Feasibility Report for Proposed Public Toilets (D15/58448) Jubilee Community Tennis Court During the discussion, Cr Barbaro raised a point of order in relation to Cr Jones entering debate rather than asking a question. The Mayor ruled against the point of order and allowed Cr Jones to continue with his question.

13.4 First Quarter Budget Review for the Financial Year Ending 30 June 2016 (D15/65065) Mrs Anna-Lucia Draper, Manager Finance & Rating Operations provided a summary of the first Quarter Budget Review.

Mr Thornton Harfield provided an updated on the Capital Works program for Quarter 1 of the Financial Year ending 30 June 2016.

That Council adopts the First Quarter Budget Review for the period 1 July 2015 to 30 June 2016, as detailed in Attachment 1 of the report entitled “First Quarter Budget Review for the Financial Year ending 30 June 2016” and dated 24 November 2015 which reflects a $4.585m forecast surplus for the year ending 30 June 2016.

That Council endorses the Marketing Strategy for the Modbury Precinct Revitalisation Project as outlined in Attachment 1 in the report entitled “Modbury Precinct Marketing Strategy” and dated 24 November 2015 noting that it will be further refined once market research is conducted in 2016.

21. Other Business Cr Keane thanked Elected Members and Council staff including Mrs Ingrid Wilkshire and Mr Brett Steiner in assisting with a matter relating to the holding cells at the old Tea Tree Gully Police Building.

Mayor Knight advised the meeting that a former Council employee Ms Dawne Thomas had recently lost her husband unexpectedly and flowers have been sent to her on behalf of Council.

24. Section 90(2) Local Government Act 1999 – Confidential Items

24.1. Outcome of Invitation for Expression of Interest for a portion of former O-Bahn Linear Park North Reserve Modbury (D15/65938)

That pursuant to Section 90(2), (3)(b) (i) and (ii) of the Local Government Act 1999, the Council orders that the public with the exception of staff on duty be excluded from the meeting to enable discussion on the Outcome of Invitation for Expression of Interest for a portion of former O-Bahn Linear Park North Reserve Modbury on the basis that it relates to information the disclosure of which could reasonably be expected to confer a commercial advantage on a person with whom the council is conducting, or proposing to conduct, business, or to prejudice the commercial position of the council; AND information the disclosure of which would, on balance, be contrary to the public interest, and, the Council is satisfied that the principle that the meeting should be conducted in a place open to the public has been outweighed in relation to this matter by the need to keep the discussion of this matter confidential.

24.1 Outcome of Invitation for Expression of Interest for a portion of former O-Bahn Linear Park North Reserve Modbury (D15/65938) During the seconding of the motion, Cr McLafferty re-entered the meeting at

8.42pm.

During the discussion of the motion, Cr Massey raised a point of order in relation to the Mayor entering into the debate with Councillors regarding traffic access to the site. The Mayor ruled that there was no point of order and continued with the matter.

Moved Cr Headland, Seconded Cr Hanson That following the Expression of Interest process, Council authorises the Chief Executive Officer to enter into a contract prepared by Council’s appointed land agent for the disposal of Allotment 3 in Deposited Plan 110715 described in Certificate of Title Volume 6161 Folio 969 and Allotment 4 in Deposited Plan 110715 described in Certificate of Title Volume 6161 Folio 970 for an amount no less than $1,400,000 including GST and as per Attachment 3 of the report entitled “Outcome of Invitation for Expression of Interest for a portion of former O-Bahn Linear Park North Reserve Modbury” and dated 24 November 2015.

1. That pursuant to Section 90(2) and (3)(b) (i) and (ii) and Section 91(7) of the Local Government Act 1999, the Council orders that the report and minute number 336 entitled Outcome of Invitation for Expression of Interest for a portion of former O-Bahn Linear Park North Reserve Modbury and dated 24 November 2015 be kept confidential until the passing of the last cooling off date of the current 7 allotments at this location has occurred or the Council resolves otherwise, whichever occurs first, on the basis that it relates to information the disclosure of which could reasonably be expected to confer a commercial advantage on a person with whom the council is conducting, or proposing to conduct, business, or to prejudice the commercial position of the council; AND information the disclosure of which would, on balance, be contrary to the public interest.

2. That the Council gives the power pursuant to Section 91 of the Act to the Chief Executive Officer to revoke the order made under Section 91(7) subject to the Chief Executive Officer consulting with the Mayor and reporting to the Council of the revocation.
