2. UNDERTAKES PUBLICATION THROUGH VARIOUS MEDIUM TO INFORM THE

SUBDIVISION OF THE SITE INTO A MAXIMUM OF THIRTY-FOUR (34) LOTS (33

RESIDENTIAL LOTS PLUS A BALANCE LOT), AND REMOVAL OF VEGETATION;

AND SUBJECT TO THE FOLLOWING CONDITIONS

1. AMENDED PLANS

BEFORE THE PLAN OF SUBDIVISION IS CERTIFIED, AMENDED PLANS TO THE

SATISFACTION OF THE RESPONSIBLE AUTHORITY SHALL BE SUBMITTED TO

AND APPROVED BY THE RESPONSIBLE AUTHORITY. WHEN APPROVED, THE

PLANS WILL BE ENDORSED AND WILL THEN FORM PART OF THE PERMIT.

APPLICATION, BUT MODIFIED TO SHOW:

COUNCIL MINUTES 3 21 JUNE 2010 (C) DELETION OF THE SMALLER LOTS (24 & 25) OR THEIR RELOCATION SO

AS TO BE INTERNAL LOTS WITHIN THE SUBDIVISION, AND TO EACH

HAVE A MINIMUM AREA OF 450M2. AT THE GRACEDALE AVENUE

INTERFACE, LOTS 24 & 25 SHOULD BE REPLACED WITH A MAXIMUM OF

TWO EAST-WEST ORIENTED LOTS WHICH DIRECTLY ACCESS

GRACEDALE AVE, OF MINIMUM LOT SIZE OF 700M2. THE ACCESS

DRIVEWAYS TO THESE LOTS SHALL NOT BE CONSTRUCTED BEYOND

THE NORTHERN BOUNDARY OF THE NORTHERN-MOST LOT IN THIS

LOCATION.

(D) TOTAL NUMBER OF RESIDENTIAL LOTS REDUCED TO A MAXIMUM OF

THIRTY THREE (33) LOTS PLUS A BALANCE LOT, IN ORDER TO

ACCOMMODATE THE PROVISION OF OPEN SPACE AS LAND, AND THE

TRUNCATION OF THE INTERNAL ROAD. A MAXIMUM OF THIRTY-ONE (31)

LOTS TO BE ACCESSED OFF LONG VIEW ROAD, AND TWO (2) LOTS TO

BE ACCESSED OFF GRACEDALE AVENUE.

(E) THE CONSTRUCTED ROAD BETWEEN LOTS 10 AND 11 TO BE DELETED,

HOWEVER WITH THE ROAD RESERVE TO BE MAINTAINED. THIS

RESERVE IS TO BE LANDSCAPED AND MUST INCORPORATE A MINIMUM

1.5 METRE WIDE PEDESTRIAN/BICYCLE PATH WHICH CONNECTS

THROUGH TO THE SOUTHERN BOUNDARY OF THE SITE.

(F) THE PLAN MUST INCLUDE THE FOLLOWING TEXT (OR SIMILAR

WORDING AS APPROVED BY THE RESPONSIBLE AUTHORITY) IN A





PROMINENT LOCATION AND BOLDED: “NB: BUILDING ENVELOPES ARE

INDICATIVE OF WHERE ON A LOT A DWELLING MAY BE SITED.

NEVERTHELESS PLANNING AND BUILDING CONTROLS AND

REGULATIONS CONTINUE TO APPLY. THIS INCLUDES CLAUSES 42.03

(I) ALL FOOTPATHS TO BE SHOWN AS MEASURING A MINIMUM 1.5 METRES

IN WIDTH AND CONSTRUCTED IN ACCORDANCE WITH COUNCIL

STANDARD DRAWING SD-F01.

(J) THE INTERNAL PEDESTRIAN/BICYCLE ROUTE/NETWORK MUST BE

SHOWN AS CONNECTING ONTO THE EXTERNAL NETWORK AT

APPROPRIATE LOCATIONS TO THE SATISFACTION OF THE

RESPONSIBLE AUTHORITY. CONNECTIONS SHALL BE MADE THROUGH

THE PUBLIC OPEN SPACE AREA AT THE WESTERN END OF THE

SUBDIVISION AND THE UNCONSTRUCTED ROAD RESERVE IN THE

SOUTH-EAST CORNER OF THE SITE.

(K) MODIFIED INTERNAL ROAD PROFILES TAKING INTO CONSIDERATION

PRIOR TO THE ENDORSEMENT OF PLANS IN ACCORDANCE WITH CONDITION

1, A TREE REMOVAL PLAN TO THE SATISFACTION OF THE RESPONSIBLE

AUTHORITY SHALL BE SUBMITTED TO AND APPROVED BY THE

RESPONSIBLE AUTHORITY. WHEN APPROVED, THE PLANS WILL BE

ENDORSED AND WILL THEN FORM PART OF THE PERMIT. THE PLANS MUST

BE DRAWN TO SCALE (AT A1 SIZE) WITH DIMENSIONS AND THREE (3) COPIES

COPIES MUST BE SUBMITTED. IT MUST ADDRESS THE FOLLOWING

MATTERS:

(A) STREET PLANTINGS.

(B) LANDSCAPING IN THE UNCONSTRUCTED ROAD RESERVE AT THE

SOUTHEAST CORNER OF THE SITE.

(C) LANDSCAPING IN THE PUBLIC OPEN SPACE AREAS.

(D) LANDSCAPING IN ALL OTHER RESERVES ON SITE.

(E) A PREDOMINANTLY NATIVE PLANTING THEME THROUGHOUT.

(F) PLANTINGS AND OTHER SOFT AND HARD LANDSCAPING ELEMENTS

PROPOSED WITHIN THE RESERVES.

(G) WATER SENSITIVE URBAN DESIGN (WSUD) INCORPORATED INTO THE

DESIGN TO THE SATISFACTION OF THE RESPONSIBLE AUTHORITY.

(H) RETENTION OF EXISTING TREES IN ACCORDANCE WITH THE TREE

REMOVAL PLAN APPROVED UNDER CONDITION 2.

4. CONSTRUCTION MANAGEMENT PLAN

PRIOR TO THE CERTIFICATION OF THE PLAN OF SUBDIVISION, A

CONSTRUCTION MANAGEMENT PLAN TO THE SATISFACTION OF THE

RESPONSIBLE AUTHORITY SHALL BE SUBMITTED TO AND APPROVED BY

THE RESPONSIBLE AUTHORITY. WHEN APPROVED, THE PLAN WILL BE

ENDORSED AND WILL THEN FORM PART OF THE PERMIT. THE PLAN MUST

ADDRESS THE FOLLOWING:

(A) DAYS OF THE WEEK/HOURS OF THE DAY WHEN CONSTRUCTION

WORKS ARE ANTICIPATED TO OCCUR (WHERE CONSTRUCTION WORKS

MINIMISING TRANSPORTATION OF DIRT/SEDIMENT ONTO

SURROUNDING ROADS AND/OR ENTERING THE DRAINAGE SYSTEM.

INTERSECTION, AS DESCRIBED UNDER CONDITION 1(M). ALL WORKS

CONSTRUCTED OR CARRIED OUT MUST BE IN ACCORDANCE WITH THESE

PLANS.

6. TREE PROTECTION FENCING

PRIOR TO COMMENCEMENT OF BUILDING AND WORKS ASSOCIATED WITH

THE APPROVED SUBDIVISION, TREE PROTECTION FENCING AND MULCHING

AS REQUIRED BY CONDITION 4 MUST BE COMPLETED TO THE SATISFACTION

OF THE RESPONSIBLE AUTHORITY. THIS FENCING MUST REMAIN UNTIL

COMPLETION OF ALL WORKS ASSOCIATED WITH THIS SUBDIVISION.

7. PUBLIC OPEN SPACE

THE PLAN MUST SET ASIDE AN AREA OF PUBLIC OPEN SPACE IN THE

LOCATIONS AS OUTLINED IN CONDITION 1(A), EQUIVALENT TO A MINIMUM OF

5% OF ALL LAND IN THE SUBDIVISION.

REQUIRMENTS PRIOR TO THE ISSUE OF A STATEMENT OF COMPLIANCE

8. VEGETATION OFF-SET PLANTING MANAGEMENT PLAN

PRIOR TO THE ISSUE OF A STATEMENT OF COMPLIANCE AN OFF-SET

PLANTING MANAGEMENT PLAN SHALL BE SUBMITTED TO AND APPROVED

BY THE RESPONSIBLE AUTHORITY TO SHOW APPROPRIATE OFFSETS FOR

NATIVE VEGETATION REMOVAL. THIS PLAN MUST BE TO THE SATISFACTION

OF THE RESPONSIBLE AUTHORITY AND THE DEPARTMENT OF
